More than 60 percent of people arrested for fare evasion in the second quarter of the year were black or African American, according to the most recent fare evasion data published by the NYPD. Another 25 percent were listed as “Hispanic.”

Black and African American people accounted for 414 of the 682 people arrested from April 1 to June 30, while Latinx/Hispanic people accounted for 175 arrests. City law requires the NYPD to publish the fare evasion arrest data every quarter.

“The city continues to arrest black and brown people for fare evasion at rates that are grossly disproportionate when compared to rates of white people,” said Councilmember Rory Lancman, who last year sued the NYPD to obtain the fare evasion data under city law. Lancman sponsored the 2017 bill mandating the reports.

The NYPD publishes the racial, age and gender breakdown of the 10 stations with the highest arrest totals. Seven of those stations are located in Brooklyn:

  • Jay Street-Borough Hall
  • Sutter Avenue
  • Nostrand Avenue
  • Nevins Street
  • Hoyt-Schermerhorn
  • 53rd Street
  • Stillwell Avenue-Coney Island

Of the three others, two are in the Bronx and one is in Manhattan at 125th Street.

The disproportionate arrest rate for people of color is even more drastic at those 10 locations, where 68.2 percent of the 148 people arrested were black or African American (101 of 148), and more than 20 percent (30 of 148) were identified as Hispanic by the NYPD.

Fare evasions citywide have dropped significantly in recent years as district attorneys in Manhattan and Brooklyn have declined to prosecute most offenses, but the NYPD continues to target people of color for “what is basically a crime of poverty,” said Legal Aid Society Supervising Attorney Anthony Posada.

All but 14 of the people arrested in the second quarter were issued a desk appearance ticket, an order to appear in criminal court to respond to the misdemeanor charge. Though a fare evasion charge alone rarely results in jailtime, it can still affect employment and access to public benefits for those arrested, Posada added.

The charge is particularly dangerous for immigrants, who could be exposed to the threat of Immigration and Customs Enforcement arrest and deportation by appearing in court, he said.

“It has been abundantly clear for years now that the NYPD is incapable of curtailing its disparate enforcement and we urge the city to cease criminalizing poverty because the human cost is too high,” Posada said.

For every one supermarket in Bedford-Stuyvesant, there are more than 50 bodegas, according to the New York City Department of Health and Mental Hygiene’s most recent Community Health Profiles.

The profiles, compiled by the New York State Department of Agriculture and Markets using late-2016 figures, underscore a present-day issue of food inequity, or, inaccessibility to high-quality foods, an issue City Council Speaker Corey Johnson has recently targeted with a multi-pronged plan.

Bodegas are less likely to have healthy food options than supermarkets, according to the profiles, and shoppers are more likely to make healthy choices when nutritious, affordable food is readily available.

In simpler terms: the lower the ratio of supermarkets to bodegas, the healthier the community.

Bedford-Stuyvesant’s ratio — 57 bodegas for every supermarket — is the highest in all of New York City. Sunset Park is close behind, with 45 bodegas to every supermarket.

In the communities of Flatlands and Canarsie, on the other hand, there are nine bodegas for every one supermarket.

“It’s outrageous that not all New Yorkers have the same access to healthy food,” said Johnson. “Something as basic as having a supermarket within a reasonable distance of your home is a big part of that.”

For 10-year Bed-Stuy resident Rae Gomes, food justice coordinator at the Brooklyn Neighborhood Health Action Center (a part of the Health Department’s Center for Health Equity), the issue is both personal and professional.

“It’s not particularly profitable for bodegas to sell fresh fruits and vegetable,” she told the Brooklyn Eagle, stressing that, while there are already initiatives in place to help make bodegas healthier, there’s often pushback from storeowners. “Bodegas have to buy these products in bulk, and they’re not always able to sell them as quickly as a supermarket might. A lot of this stems from the fact that there is no food distribution system that is not profit-based.”

It’s largely about coming together as a community to work towards a common goal, she said.

“It would benefit bodegas if we had a food distribution system that allowed them to sell these fresh fruits and vegetables based on community good versus profit,” Gomes said, pointing to Gov. Andrew Cuomo’s Vital Brooklyn Initiative, currently in the feasibility stages of creating a Central Brooklyn food hub.

Another important factor in a community’s health, Gomes added, is its access to things like food coops and farmer’s markets — the latter also tracked by the Community Health Profiles. (Bed-Stuy is home to five of the city’s farmer’s markets and Sunset Park to two, according to the profiles. Brownsville, on the other hand, has eight — the most in the borough.)

“It’s really about community self-determination,” she said, tipping her hat to such groups as the Central Brooklyn Food Coop and and Brownsville’s Food Advisory Council. “I would say [to anyone who wants to learn more about their neighborhood’s access to healthy food], to join the efforts of the community groups that are out there.”

“Communities know what they need, and if you strengthen their access, you allow them to create their own solutions,” Gomes said. “We have to work to get community control of the distribution system.”

Like many of the world’s rich, Dmitry Rybolovlev is a patron of the arts. He is a renowned collector of the kind of paintings art historians write about. And he claims to have lost upwards of $1 billion in art purchased through Swiss art dealer Yves Bouvier. The legal battle between Rybolovlev and Bouvier to some of the art world is legend.

Works of art, which cost more than Rybolovlev’s New York, Hawaii and Monaco homes combined, are now the source of more pain than pleasure. His legal battle with Bouvier has roped in a quiet and respected middleman, the publicly traded, luxury auctioneer Sotheby’s of New York. He’s suing Sotheby’s for $380 million. According to the claimant, Bouvier “defrauded” Rybolovlev of more than $1 billion. Often selling him artwork at enormous 70%, markups on paintings he had just purchased. The dispute over some 38 paintings, of which less than half involved Sotheby’s, has spawned civil and criminal litigation in at least five jurisdictions around the world — Singapore, Switzerland, France, Monaco, and the United States. They claimed to the court that Sotheby’s “materially assisted the largest art fraud in history”.

A New York Southern Circuit Court judge ruled in June against Sotheby’s motion to dismiss evidence and remove the case from New York. The auction house’s attorneys wanted to seal the correspondence between a Sotheby’s Vice Chairman for worldwide private sales named Samuel Valette and Bouvier, citing damage to the company’s reputation. For almost a year Sotheby’s objected to the use of these documents in the Swiss criminal proceedings against Bouvier, with the Russian side arguing that it was because of the tight knit working relationship between the two that reveals Bouvier’s “fraud”. The email correspondence can now be used in Rybolovlev’s legal proceedings with Bouvier in Switzerland and bring this story to an end.

The New York court documents showed extracts from the correspondence between Valette and Bouvier, noting that the messages were “designed to induce Rybolovlev to pay inflated, fraudulent prices” and then used Sotheby’s as a “veneer of legitimacy and expertise” by providing “inflated appraisals on demand.”
