The Delhi High Court ruled that paying a service charge on food bills is voluntary and cannot be made mandatory by restaurants or hotels.
The high court clarified that the compulsory collection of service charges is unlawful, and that consumers may leave voluntary tips if they wish. It stressed that service charges should not be added automatically, but should be left to the “consumer’s discretion”.
